LMA - PAC Resolution

RESOLUTION


Whereas, on October 19, 2006, Director James Roof moves that the Board of Directors of the Lake Milton Association, Inc. create a political action committee of the Lake Milton Association, Inc. with the following duties and responsibilities. Said motion received a second from Officer Ron Schulz.
Name of Committee: Lake Milton Association – Political Action Committee (LMA-PAC).
Mission Statement: To preserve, protect and defend the property rights and the civil liberties of the members of the Lake Milton Association and of the members of the Lake Milton community.
Funding: A) The LMA-PAC shall maintain its own funds separate from those of the Lake Milton Association. Pursuant to law, any member may choose to donate up to fifty percent (50%) of their annual dues of the Lake Milton Association to the LMA-PAC and any person or any other legal entity may make such other contribution as allowed by law. B) The LMA-PAC or the Board of Directors of the Lake Milton Association or both reserve the right to decline or return any donation.
C) The Treasurer of the Lake Milton Association shall create a “check off” system on the annual dues invoice for the Association. The person(s) responsible for invoicing the Lake Milton Association membership shall inform the members that dues may be paid with two checks, one check payable to the Association for their dues and another check payable to the LMA-PAC for up to 50% of their dues. NO CORPORATE CHECKS CAN BE ACCEPTED BY THE LMA-PAC. PAYMENT MUST BE MADE BY A SEPARATE PERSONAL CHECK ONLY. In the alternative, if the member pays the yearly dues and indicates a LMA-PAC donation or % of dues allocation to LMA-PAC with one check, the check WILL BE RETURNED AND SEPARATE CHECKS WILL BE REQUESTED.
D) The Lake Milton Association and the LMA-PAC shall inform the Association membership of the above alternatives in payment of dues and making contribution over and above the dues.
E) The funds of the LMA-PAC shall be kept in the custody of the Treasurer of the LMA-PAC at a local federally insured financial institution. The Treasurer of the LMA-PAC shall make a report to the LMA-PAC, the Board of Directors of the Lake Milton Association at each of the Board of Directors Meetings and to the General Members as directed by the Board of Directors, but not less than annually at the General Membership meeting.
F) The books and records of the LMA-PAC, including all banking and financial records, shall be open for inspection to any member of the Association at a reasonable time and place to be determined by the Treasurer of the LMA-PAC.
G) Checks shall be signed by the Treasurer of the LMA-PAC and the President of the Lake Milton Association, but if the President does not sign, for any reason, then the Board of Directors of the Lake Milton Association or the members of the Lake Milton Association may designate another member to sign in the President’s place.

Officers and Committees: The LMA-PAC shall have a chairperson, treasurer, secretary and sub-committee chairs. The Board of Directors shall choose the chairperson of this committee and the chairperson shall select the sub-committee chairs. The LMA-PAC will have the following standing sub-committees:

Finances and Banking
Communications
State Affairs
Community Affairs
Research
The Chairperson of the LMA-PAC may create a new sub-committee as needed and as times and issues change. The number of members of each sub-committee shall be determined by the chair of each sub-committee and the number may fluctuate depending upon available members. Any member of the Lake Milton Association may be a participating member of any sub-committee. This does not mean rotating sub-committee members. All members of the LMA-PAC must be LMA Members.
The sub-committee chairpersons and the chairperson of the LMA-PAC shall constitute the voting body of this committee for committee action and resolutions.
Upon the approval of a majority of the officers of this committee, the LMA-PAC may employ such professionals and enter into contracts as necessary to carry out its mission and perform its functions, including but not limited to, attorneys, accountants, advertising specialists, researchers, or any like professional but is limited to the funds available in the LMA-PAC budget.
The LMA-PAC shall have the following duties and responsibilities:
1. Inform the LMA membership and the community on facts and issues that affect the property rights or affect the civil liberties or both of the members of the Lake Milton Association or the Lake Milton community generally.
2. Present Pro and Con Commentary containing a proviso that it is not necessarily the formal position of the Lake Milton Association and a website will be developed so that no response may be forwarded to the entire LMA membership but rather to the website.
3. Financially support those issues and candidates that further the mission statement of the LMA-PAC with the approval of a majority of the Board of Directors of the Lake Milton Association or the approval of a majority of the members of the Lake Milton Association voted upon at any meeting properly called.
The Chairperson of this LMA-PAC together with one other officer or director of the Lake Milton Association may call a meeting of the Board of Directors of the Lake Milton Association or a membership meeting of the Lake Milton Association to consider matters regarding the rights of the Association members and the duties of this committee. These meetings will be for the purpose, but not necessarily the sole purpose, of determining any official Association position on matters that affect property rights or civil liberties of Association members, of determining whether to make financial contributions to candidates or causes which support issues that affect property rights or civil liberties of Association members, and/or of taking any other appropriate actions in furtherance of the mission of the this committee.

Following a full discussion of the Motion, the vote was duly held and the Motion passed by a majority vote as amended.
